Who is this waiver for?

Adult participation agreement, assumption of risk, and release of liability

Waiver version 1

Read each section carefully. Initial every section, then complete the participant details and electronic signature.

This agreement affects legal rights. Read it carefully before signing. An adult participant must sign for themselves before entering a Covered Activity.

1. Participant, activities, and people covered

I am the adult participant identified with this agreement.

Covered Activities include Brazilian jiu-jitsu, grappling, wrestling, martial-arts instruction, demonstrations, drilling, live rolling or sparring, conditioning, open mats, private lessons, seminars, camps, competitions, special events, and other activities offered, organized, sponsored, or supervised by CJJA. They also include being in CJJA training, changing, common, entry, exit, and parking areas and using CJJA-provided equipment.

Released Parties means Charlotte Jiu-Jitsu Academy LLC and its owners, officers, employees, instructors, coaches, contractors, volunteers, agents, successors, and assigns while acting in connection with CJJA or the Covered Activities.

2. Risks I understand and accept

The Covered Activities involve strenuous exercise, close physical contact, throws, takedowns, joint locks, chokes, pins, falls, collisions, and unpredictable actions by other participants. Possible harm includes bruises, cuts, skin or communicable infections, sprains, strains, torn muscles or ligaments, dislocations, fractures, dental or eye injuries, loss of consciousness, concussion, damage to the head, neck, spine, nerves, or internal organs, paralysis, permanent disability, and death. Some risks may be unknown or not obvious when this agreement is signed.

I choose to participate voluntarily and knowingly accept all inherent and reasonably foreseeable risks of the Covered Activities, whether known or unknown, including risks arising from the ordinary negligence of a Released Party. No rule, instructor, safety measure, or equipment can eliminate every risk.

3. My health and safety responsibilities

I am responsible for deciding whether I am physically and medically able to participate and for seeking medical advice when appropriate. I will not train while knowingly contagious, impaired, or affected by an injury, illness, concussion, or other condition that makes participation unsafe. I will stop and tell an instructor about a warning sign, follow CJJA safety, hygiene, facility, and conduct rules, and follow instructor directions. CJJA may refuse or stop my participation when it reasonably believes participation is unsafe or disruptive.

4. Release and promise not to sue

To the fullest extent permitted by North Carolina law, I release the Released Parties from claims, demands, causes of action, damages, losses, and expenses arising from my presence at CJJA or participation in the Covered Activities, including claims alleging a Released Party's ordinary negligence in instruction, supervision, premises, equipment, another participant's conduct, first aid, emergency response, or the decision to allow or stop participation. I promise not to file or maintain a lawsuit for a released claim. This release binds me and, where permitted by law, my estate, heirs, personal representatives, and assigns.

This agreement does not release gross negligence, willful or wanton misconduct, intentional wrongdoing, or any duty or claim that North Carolina law does not permit to be released.

5. Emergency care, conduct, and property

If I am injured or unable to communicate, I authorize CJJA to provide or seek basic first aid, call emergency services, and arrange emergency treatment or transportation. CJJA is not a medical provider, and I am responsible for charges not paid by insurance or another responsible party.

I am responsible for my property and for harm or property damage caused by my negligent, reckless, or intentional conduct or a material false statement about my identity. To the fullest extent permitted by law, I will indemnify the Released Parties against third-party claims arising from that conduct, but not for a Released Party's gross negligence, willful or wanton misconduct, intentional wrongdoing, or liability that cannot lawfully be shifted to me.

6. Duration, governing law, and electronic signature

This agreement applies to my present and future Covered Activities until CJJA requires a newer version. A later version does not erase this record or change its effect for earlier activity. CJJA will preserve the exact agreement, initials, signer, and signing time.

North Carolina law governs this agreement. Any lawsuit concerning it must be brought in a court with jurisdiction in Mecklenburg County, North Carolina, unless applicable law requires another location. If a court finds one provision unenforceable, that provision will be narrowed or removed only as necessary and the remaining provisions will continue in effect.

I confirm that I am at least 18 years old, have read and understand this agreement, had time to review it and ask questions, and sign voluntarily. My intentional acceptance, initials, and typed name are my legal electronic signature, and I can obtain a copy.

This training waiver is separate from membership, billing, the required recording and media agreement, and marketing-email consent.

Required recording and media agreement

I understand and agree that CJJA continuously records video of the mats, entrances, common areas, and exterior areas for safety, security, incident review, and protection of participants and the academy. Recording notices are posted at the gym. Security video is normally retained for 30 days, but relevant footage may be preserved longer for an incident, insurance matter, legal requirement, or dispute. CJJA does not record restrooms, changing areas, or another area intended for personal privacy. I also understand that CJJA regularly takes photographs and video during classes and events. I authorize CJJA to capture and use the participant's image, voice, first name, belt rank, achievements, or statements in CJJA-controlled educational, community, website, social-media, advertising, and promotional materials without payment. CJJA will not knowingly use the material in a derogatory, defamatory, misleading, adult-content, gambling, or political-advertising context. I may ask CJJA in writing to stop future featured promotional use or remove specific material from channels CJJA controls, but CJJA cannot guarantee removal of material already published, shared, archived, or copied outside its control. Cameras and routine class media are part of CJJA operations, so accepting this agreement is required to train or attend activities at CJJA.
